Yes, the bank can demand the whole balance at once, but not before a registered formal notice and one month without regularisation. The law limits the cases, and what the issuer may add to the debt is capped. On €2,000 owed, the maximum compensation is €200.
Can the bank demand the whole balance of my card at once?
Yes, in three precise cases only, and never over a simple phone call. This is called acceleration (déchéance du terme in French): you lose the right to repay by instalments, and the entire balance becomes due. The principle set by article VII.105 is the opposite: any acceleration clause is forbidden and deemed unwritten, except by exception.
A card with a credit facility falls under Book VII of the Code de droit économique, the Belgian text on consumer credit. The official text can be read on the Moniteur belge site, the official gazette. A deferred-debit card with no credit line is not under this regime, and this article does not cover it.
In the files I handled, the word "acceleration" almost always arrived in a letter the cardholder had taken for a simple reminder. The difference is one sentence: the formal notice announces that the balance will become due if nothing moves.
In which cases is acceleration allowed?
In three cases, and the table below sets them out with their condition. It follows article VII.105 as summarised by the Credit2Consumer commentary.
| Situation | Acceleration possible? | Condition |
|---|---|---|
| Two minimum monthly payments unpaid, or arrears equal to 20% of the total owed | Yes | Registered formal notice, then one month without regularisation |
| Breach of the credit limit | Yes | Registered letter, then one month without regularisation |
| Financed asset sold or used contrary to the contract | Yes | Mostly for asset-linked credit, rarely a card |
| A single late payment, caught up | No | Simple delay: reminder and interest on the overdue capital only |
| "Repay at any time on demand" clause | No | Forbidden for credit already used, without prejudice to article VII.98 |
Three points from the same commentary are worth noting. The formal notice is always required. The one-month period runs from the posting date, not from receipt. And a formal notice that gets the period wrong, or fails to restate the terms, is void: the issuer must prove it was regular.
What notice must the bank give to terminate my card?
At least two months, if it terminates without any fault on your side. Article VII.98, § 1, sets this minimum for an indefinite-duration contract, by registered letter or another medium you accept, and only if the contract provides for it. You, on the other hand, may terminate at any time, free of charge, with a notice of one month at most (see the Credit2Consumer commentary on the same article).
Contracts may go further than the law. Rate checked with the issuer on 13 October 2026: the Beobank Visa Classic costs €5 in annual fee, with an APR of 14.49% on a €2,150 credit facility (public Beobank page). Its general conditions, consulted the same day, write a three-month notice in article 17, not two.
Notice does not erase the debt. At its end, the overdue capital and the overdue cost of credit must be repaid. If that is not done, late interest and compensation run only after a registered formal notice and a three-month period (article VII.106, § 2, as reflected in Beobank's article 17).
How much can the bank add to the debt?
Much less than the amount reminder letters let you imagine. Once the term is due or the contract terminated, article VII.106, § 1, allows only five things to be claimed: the remaining balance, the overdue and unpaid cost of credit, the agreed late interest on the balance, and penalties capped at 10% of the balance band up to €7,500, then 5% above.
Two worked examples, my calculations. On €2,000 owed, the maximum compensation is €200. On €9,000 owed, it rises to €825: €750 for the first band, €75 for the remaining €1,500.
Late interest cannot exceed the last borrowing rate, plus 10%. At Beobank, that is the actuarial rate of 13.98% multiplied by 1.10, or about 15.38% a year (article 13.1 of the general conditions). On €2,000, that is roughly €25.60 a month. Over twelve months, that is a little over €300, compensation excluded.
A point the brochure does not put forward: after acceleration, your payments go first to the balance and the cost of credit, and only then to late interest, compensation and fees (VII.106, § 5, reflected in Beobank's article 13.6). The order works in your favour.
Any clause providing penalties the law does not authorise is deemed unwritten (VII.106, § 6), and a judge may reduce an excessive penalty. You also have the right to ask for a detailed, free statement, up to three times a year.
Beobank and Buy Way: the clauses as written
Both contracts follow the law, with variations. The general conditions of Beobank's credit facility, consulted on 13 October 2026, restate word for word the threshold of two instalments or 20%, the month after a registered letter, the 10% then 5% compensation and the report to the Credit Register (articles 13.3 and 13.4). They also specify that a cardholder declared bankrupt loses the benefit of the term automatically. I did not find that case in the list of article VII.105: it comes from the contract.
They also contain a clause that works in the cardholder's favour: if the bank itself causes the consequences of acceleration, it owes compensation capped at the same percentages (article 13.5).
At Buy Way, the Mastercard One guide consulted on 7 October 2026 does not restate these clauses, which are referred to the full general conditions. Rate checked with the issuer on 7 October 2026: annual fee €17.50, APR 14.50% for a €5,000 credit facility. The guide states that if the balance is not brought to zero by the zeroing date, use of the card is suspended, then the default is reported to the negative section of the Credit Register.

What should I do on receiving a registered formal notice?
Date it, read it, answer in writing within the month. I cannot say which option suits your situation, but these steps leave a trace in a file:
- note the postmark date, which opens the month;
- check that the letter restates the terms and gives an itemised amount;
- ask for the free statement, line by line;
- offer a payment plan or dispute what is inaccurate, by letter or email, never by phone alone.
In the files I handled, the cardholder's letter changed how the file was read. The issuer looks first at whether there is a written trace after the formal notice. When there was none, the file went to litigation with no further review.
What happens at the Credit Register?
With Beobank, acceleration comes with a report of the default to the Centrale des Crédits aux Particuliers, the Individual Credit Register run by the National Bank of Belgium (article 13.4). Retention periods, the delay before registration and free consultation of your record are detailed in the article on the Individual Credit Register.
Who can I turn to if the statement is a problem?
First a written complaint to the issuer's complaints service. Then Ombudsfin, the financial services ombudsman, free of charge, whose opinion is not binding. If the file goes to a collection agency, the rules are detailed in the article on the debt collection agency. For a debt the budget can no longer repay, see debt mediation and the FPS Economy information on over-indebtedness.
On a rate rise during the contract, see the bank raising your card rate. To compare the cost of a carried balance card by card, the ranking of Belgian credit cards, the comparison tool and the selection guide use the same checked rates.
