Double charge or subscription billed after cancelling

Double charge or subscription billed after cancelling by card: dispute deadlines, proof of cancellation, which reason to pick and free Ombudsfin recourse.

ByDelphine V.9 min read

Yes, a double charge and a subscription billed after cancellation can both be disputed by card, but they are not the same file. The first is a billing error, the second a dispute over the cancellation date. The deadline that presses is not the law's: it is your issuer's.

Is a double charge really a double charge?

Not always. The Visa network defines multiple billing by three identical elements: the same card, the same amount and the same transaction date. Two lines of EUR 9.99 a month apart are a subscription working normally.

Visa's dispute guide, dated October 2026, adds that the merchant may answer that each line is a separate purchase. That is its first argument, and often the right one.

In the files I handled in Liège, the "double charge" was first of all an authorisation followed by its debit: two lines for one operation, the first of which disappeared by itself a few days later.

What should you do, in order, for a subscription billed after cancelling?

Write to the merchant first, dispute next, and never wait for the reply before dating your file. This is the order I gave on the phone, with no guarantee of result:

  1. Find your proof of cancellation: confirmation email, screenshot of the page, proof of sending. It is the document that decides the file.
  2. Note three dates: the cancellation, the effective date the merchant announced, and the disputed debit.
  3. Write to the merchant to withdraw the direct-debit or card authorisation and claim the refund. Keep proof of sending.
  4. Fill in your issuer's dispute form without waiting for the merchant's reply.
  5. Watch the next statement: a new debit after that letter is the strongest argument in the file.

Beobank leaves no doubt about the order of things. Its dispute form has a reason "membership or registration cancelled", which requires the cancellation date and a copy of the proof. For services not provided, it first asks you to look for an arrangement with the merchant and to note its answer.

The date, always the date.

A file without a cancellation date comes back with a request for more. A file with a date and a proof is handled like any ordinary dispute.

What does Belgian law say about cancelling and renewal?

It frames renewal, not the debit. The card dispute remains a contractual mechanism, but cancellation itself has a legal basis you can put to the merchant.

Two texts matter. The first is Article VI.91 of the Code of Economic Law (Belgium's consumer and business code), completed by the Act of 20 April 2026. From 1 May 2027, a business must warn the consumer of the automatic renewal of a service contract, on a durable medium, at the latest 15 days before the objection deadline. Contracts of one month or less are excluded, and the Act sets no sanction of its own: according to the analysis published by Mondaq, a missed reminder does not cancel the renewal. Before that date, the reminder is not required.

The second is already in force: after a tacit renewal, the consumer can terminate at any time, with at most two months' notice and no compensation. A subscription taken out at a distance also carries a 14-day right of withdrawal, unless the service has already been performed with your agreement.

How long do you have to dispute?

Four deadlines coexist, and they do not add up. In practice the shortest one wins.

DeadlineSourceWhat it applies to
14 daysBeobank dispute form, September 2021 revisionreturning a card dispute file
3 monthsEuropean Consumer Centre Belgiumchargeback, in general, from the transaction
8 weeksDirective (EU) 2015/2366, Articles 76 and 77refund of an authorised transaction whose amount was not specified
13 monthsBook VII of the Code of Economic Law (payment services)notifying an unauthorised transaction

The third deadline is rarely applicable. It assumes the amount was not fixed at authorisation and exceeds what you could reasonably expect. A EUR 9.99 subscription charged at EUR 9.99 almost never falls within it.

The fourth is the fraud deadline. It does not cover a subscription you took out yourself, even after cancelling: the law does not say that a debit after your cancellation becomes an unauthorised transaction, and Visa's dispute guide files it in a category of its own, separate from fraud.

On a SEPA direct debit the rule is simpler: eight weeks of refund without conditions, and a block possible until the end of the business day before the debit (Articles 76 and 80 of the directive). A card does not offer that guarantee.

Which reason should you choose for the file?

The one that matches your proof, not your irritation. The issuer looks first at the cancellation date against the debit date, before the amount.

Visa's dispute guide for the cancelled recurring transaction condition says it plainly: the cardholder is in principle responsible for sums due before the effective date of cancellation. A merchant can answer that the request was for a future date and that the debit pays for a service already given. If you cancel on the 10th for a cycle ending on the 30th, a debit on the 25th is probably due.

My rule, after seven years of files: a cancellation without a date is a file without proof. And a file without proof is lost, even when the cardholder is right.

What evidence should you gather?

Dated documents, nothing else:

  • the cancellation confirmation, with its time and channel;
  • the statement screenshot showing the disputed line, amount and date included;
  • the email withdrawing the authorisation, and the merchant's reply if there is one.

Keep them outside the merchant's account: a cancelled subscription often closes access to the proof.

A filled-in dispute form next to a crumpled receipt
In a subscription file, the cancellation date is read before the amount.

What does waiting cost if the line stays on the card?

Little in euros, but the arithmetic has two steps. As long as the disputed line stays in the outstanding balance, it earns interest at the card's rate, and the monthly debit only covers a fraction of the balance.

Two Belgian cards, with their three base figures:

CardAnnual feeAPR on a carried balanceEUR 100 withdrawalRate checked at the issuer on
Beobank Visa ClassicEUR 514.49% (EUR 2,150 credit line)EUR 5.0020 October 2026, withdrawal checked on 18 September 2026
Buy Way Mastercard OneEUR 17.5014.50% (variable borrowing rate of 13.75%)EUR 6.5020 October 2026 (September 2025 guide)

Take an annual subscription of EUR 119.88 charged by mistake and left three months on the line. At the monthly rate equivalent to 14.49%, that is about EUR 4.13 of interest. Over twelve months, it would be close to EUR 17.40. These amounts are my calculations, with no new purchase or refund in between.

The sum is not the point. The point is that a disputed amount does not release you from paying on the debit date until the issuer confirms in writing that it suspends the line. If the amount strains your budget, talk early to an approved debt mediation service or to your local CPAS (the public social welfare centre). This article does not replace advice suited to your situation, and the carried-balance mechanism is detailed in the article on the minimum payment.

The issuer refuses: what next?

Write, date it, ask for the exact reason for the refusal. The complaint goes to the complaints department, not the branch, with the list of documents already sent.

Ombudsfin, the Belgian financial disputes mediator, then examines the file free of charge. According to Test-Achats (16 February 2026), the problem must be less than a year old, no court proceedings may be under way, and the answer comes in principle within 90 days. Going to the bank first remains advisable without being strictly mandatory. The opinion does not bind the institution.

A merchant that has gone bankrupt or no longer delivers opens a neighbouring file, covered in the article on the bankrupt or non-delivering merchant. The general mechanism of chargeback in Belgium completes this one.

Three points I could not verify

Beobank's form dates from 2021 and its current card page publishes no deadline: ask the issuer for the version in force. The Buy Way Mastercard One guide (September 2025) describes neither disputes nor recurring payments, and customer service answers on 02 320 25 96. Visa's and Mastercard's internal deadlines do not appear in the public extracts I read: I will not give you any.

To compare cards on what they cost rather than on their promises, the ranking of Belgian credit cards, the comparison tool and the choice guide start from the same checked rates.

Frequently asked questions

In principle yes, if you can prove the cancellation date and the charge came after it. You dispute with your card issuer through the chargeback route. Instalments dated before the cancellation took effect remain due, and the merchant can reply with its own documents.

Write to the issuer with the statement showing both lines, with identical dates and amounts. At Beobank the reason is called multiple billing: one authorised transaction charged several times. First check that the second line is not a pre-authorisation that will release by itself.

The shortest deadline is the issuer's own: 14 days to return the Beobank form in its 2021 revision. The European Consumer Centre puts chargeback within three months. The thirteen-month deadline in Book VII only covers transactions you did not authorise.

Yes, by writing to the merchant: consent can be withdrawn at any time, but never for a payment order that has already become irrevocable. The withdrawal therefore applies to future charges. For a direct debit, the bank can still block the debit until the end of the business day before it.

It protects differently. A SEPA direct debit is refundable without conditions within eight weeks. A card opens the chargeback route, on specific grounds and with documents, but without that unconditional guarantee. Bancontact does not provide for chargeback at all.

Write to the complaints department asking for the exact reason, then go to Ombudsfin. The procedure is free, the problem must be less than a year old, and the opinion does not bind the bank. If the disputed line weighs on a balance you can no longer repay, an approved debt mediation service or your local CPAS can help.
